USTOA $1 Million Travelers Assistance Program for smarTours

Updated: May 2, 2025

The filing date for USTOA claims for the USTOA $1 Million Travelers Assistance Program for smarTours has passed and no further claims will be accepted.

If smarTours' passengers timely submitted a claim to the USTOA $1 Million Travelers Assistance Program for smarTours, postmarked on or before May 1, 2025, the filing deadline date, claimants should have received an email confirmation from ustoaclaims@ustoa.com which will be a confirmation of receipt of their claim only, not a determination on their claim. If a claimant did not receive a confirmation of receipt email, please email USTOA at ustoaclaims@ustoa.com to confirm receipt of your claim.

The $1 Million proceeds of USTOA $1 Million Travelers Assistance Program will be distributed pro rata based upon the total amount of eligible claims. There is no "first come first served" policy for reimbursement. USTOA will review all claims received and/or postmarked on or prior to May 1, 2025 and contact claimants directly by email if they should have any questions.

All questions should be directed to ustoaclaims@ustoa.com.

This process will likely take months to complete. USTOA will continue to keep claimants updated on the claims process via email.

Claim form for General Assignment for the Benefit of Creditors in favor of smarTours ABC

The USTOA $1 Million Travelers Assistance Program understands that smarTours passengers may have been contacted by smarTours in connection with its cessation of business and its filing of a state court proceeding in Delaware.

This is a separate claim process than the USTOA $1 Million Travelers Assistance Program for smarTours.

The USTOA $1 Million Travelers Assistance Program recommends that you complete and file a Proof of Claim in such Delaware proceedings as soon as possible, but no later than June 16, 2025 for the amount of any deposits you advanced to smarTours for cancelled travel or for the amount of any outstanding travel credits issued to you by smarTours.

The filing of a Proof of Claim form with the Delaware proceedings does not guarantee that there will in fact be a recovery for any creditors on their claims in the Delaware court proceedings. The USTOA $1 Million Travelers Assistance Program has no role in determining whether or not you will be refunded any portion of your deposits or credits from smarTours or its assignee. The Delaware court proceedings will likely delay the ability of the USTOA $1,000,000 to make payments from its fund. A link to the proof of claim form in the Delaware court proceeding is set for the below.
